Accidents at Work

If you have been injured in an accident at work in Ireland which was not your fault, you may be entitled to make an accident or personal injury compensation claim. Under Irish law, every worker has the right to a safe place of work and a safe system of work. Employers must adhere to strict laws and regulations that are designed to protect their staff from personal injury. This includes provision of a safe system of work, a satisfactory working environment and (in particular) the identification and replacement of potentially dangerous machinery and equipment.

You can be compensated if you can prove that the accident was the fault of someone else – your employer or a fellow employee. You may be entitled to make a claim for compensation if you have had an accident at work or if you believe that you have suffered as a result of your employer being in breach of Health and Safety legislation.

Accidents in work can happen as a result of many causes, including:

  • Slips, trips and falls in a level area.
  • Falls from a height, e.g. from stairs, ladders or scaffolding.
  • Manual handling, which includes lifting and carrying, pushing and pulling, and twisting and turning of the body.
  • The use and handling of machinery, which was unsuitable for the task or not serviced correctly.
  • Exposure to chemicals and dangerous substances through a lack of protective clothing and equipment.
  • The hazards of using and moving transport vehicles in the workplace.

Road Traffic Accidents

One of the most common causes of personal injury litigation is road traffic accidents. We have vast experience in all aspects of road traffic accident claims and can advise you on your entitlement to compensation for personal injury and any other losses including medical expenses, car hire, repairs, policy excess, depreciation, loss of earnings and any other out of pocket expenses or losses incurred. If you have been involved in a road traffic accident and have suffered an injury, or had your vehicle damaged, you may be entitled to claim compensation. Every road traffic accident claim is unique; it is always best to discuss your personal circumstances with a solicitor.

Accidents on Privately Owned Property

If you have been injured due to an accident on another person’s property and the injury is as a result of the negligence of the property owner or occupier, you may be entitled to make a compensation claim. The Occupiers Liability Act 1995 places a duty on the occupiers of premises to take reasonable care so that visitors will be reasonably safe in using the premises. The occupier of any building or land must ensure they do everything that is reasonably possible to prevent you from having an accident on their property. If they are found to be negligent in fulfilling this duty of care, and you have been injured as a result, they may be liable to pay you compensation.

The most common occupier liability claims we deal with relate to accidents in shops, supermarkets, hotels, pubs, nightclubs and car parks.
